Overview

Full-time, exempt position located in Lake Zurich, IL, US within the Default Litigation, Attorney Oversight, and Mediations department. This role supports multiple departments by managing strict deadlines, adapting to new processes, collaborating across teams, and handling multiple projects related to default servicing litigation.

Responsibilities

  • Provide legal analysis, advice, and counsel on assigned litigation files.
  • Review, evaluate, and manage high-risk and highly escalated litigation matters to prevent future issues.
  • Assist with litigation, correspondence, and complaints to ensure effective and efficient handling.
  • Ensure company-wide policies and procedures are applied with full awareness of legal implications and risks; collaborate with Compliance as needed.
  • Stay current on applicable legislation, case law, administrative rulings, and pending regulations; provide counsel and training to minimize compliance risks.
  • Collaborate with other departments to monitor law changes and update procedures accordingly.
  • Review and evaluate potential litigation matters with management and legal teams.
  • Prepare and ensure timely completion of reports as directed by the Department Head.
  • Conduct research and investigate borrower correspondence and complaints.
  • Audit litigation documentation and correspondence for quality control, accuracy, and risk management.
  • Educate and train default litigation specialists on legal issues, litigation strategy, and default servicing experience.
  • Testify at trials or mediations and provide deposition testimony as needed.
  • Monitor and maintain department proxies and assist legal department with litigated loans.
  • Complete system corrections and file audits related to litigated files/loans.
  • Assist with attorney and internal issues raised by default litigation staff.
  • Audit contested pleadings and discovery.
  • Handle and oversee foreclosure, bankruptcy, eviction, and mediation matters, including attorney oversight.
  • Travel nationally up to 25%.
  • Complete annual regulatory compliance training.
  • Perform other related duties as assigned.

Required Qualifications

  • Juris Doctorate; Licensed Attorney.
  • 5 to 10+ years of experience in default servicing law firm or mortgage servicing company focusing on foreclosure, bankruptcy, regulatory issues, litigation, and/or real estate legal matters.
  • Minimum 3 years of experience handling contested default servicing litigation.
  • Working knowledge and hands-on experience with foreclosure, bankruptcy, eviction, and mediation cases.
  • Experience or knowledge of mortgage banking regulations, servicing guidelines, or operational default servicing law firm processes.
  • Extensive knowledge of federal and state laws impacting mortgage servicing, including TILA, ECOA, FCRA, FDCPA, RESPA, Fair Housing Act, Homeowners Protection Act, predatory lending laws, state foreclosure laws, and the U.S. Bankruptcy Code.
  • Strong prioritization, management, and senior management interaction skills.
  • Extensive legal writing, analysis, and research skills.
  • Experience with foreclosure, bankruptcy, eviction, mediation, and related laws and regulations.
  • Experience with LPS, Fidelity systems, and Microsoft Office.
  • Practical and efficient approach to legal issues; excellent analytical, oral, and written communication skills; good interpersonal skills; ability to persuade and present positions effectively and diplomatically.
  • Ability to work under pressure with tight deadlines on multiple issues.
  • Attention to detail.
  • Limited supervisory responsibilities.
  • Submission of a writing sample is required.
