Overview
This position is for an Attorney II responsible for defending first- and third-party cases involving personal injury lawsuits. Most matters involve injections without completed surgeries and case values up to $150,000. Cases are managed from inception through posttrial motions, including bench trials, jury trials, and binding arbitration.
An in-person interview may be required during the hiring process.
Responsibilities
- Review new and transfer file assignments and prepare an initial evaluation letter to claims, including service of initial discovery within 30 days of receipt of assignment.
- Summarize discovery responses and medical records within 30 days of receipt.
- Take and defend depositions of parties, lay witnesses, and expert witnesses; complete deposition summaries within 20 days.
- Perform legal research and draft law and motion materials, including motions, oppositions, and replies; appear in court for law and motion.
- Prepare for trial, conduct trial, and handle posttrial motions, including (but not limited to) preparation of pretrial documents, motions in limine and oppositions, jury trial execution, trial motions, and posttrial motions.
- Complete additional miscellaneous tasks necessary to adequately defend the insured, including assignments from managing and senior managing attorneys.
Qualifications
Education
- Minimum: Law degree and admission to the bar in the state(s) where practicing.
- Preferred: Law degree from a state-accredited or ABA-accredited law school and admission to the bar in the state(s) where practicing.
Experience
- Minimum: 3+ years of insurance defense or related experience, including experience as the primary attorney defending personal injury lawsuits.
- Minimum: 3+ insurance defense personal injury trials to verdict or equivalent litigation experience.
- Preferred: 5+ years of insurance defense experience.
- Preferred: 7+ insurance defense personal injury trials to verdict.
Skills and Abilities
- Comprehensive knowledge of insurance, torts, evidence, civil procedure, and trial practice.
- Effective communication, persuasion, and analytical skills.
- Requires considerable automobile travel, up to 20% of work time.
- Must meet established company standards regarding personal driving history and current license status to be eligible for the position.
- Ability to work independently with minimum direction and strong organizational skills necessary to manage a caseload with exposures up to $150,000.
- Preferred: Exceptional communication, persuasion, and analytical skills.
Compensation & Benefits
Pay Range (Base Salary)
- $128,136.00 to $252,194.00 (NJ, NY, WA, HI, AK, MD, CT, RI, MA)
- In CA: Typical hiring range is $171,148.50 to $209,181.50
- Expected base salary varies based on experience, skills, and location.
