Overview

This role involves administering claims submitted pursuant to applicable state regulations and company policies. The position is remote and requires availability during normal business hours, with occasional travel.

Responsibilities

  • Investigate each claim by gathering relevant documents from insured parties, internal operations, title/closing agents, and other third parties.
  • Analyze whether claims are covered under the policy and issue letters to insured parties explaining decisions to accept coverage, deny coverage, or defend claims under reservation of rights.
  • Determine if any company policies, procedures, or practices were violated in connection with the underlying transaction; report violations to management and recommend remedial measures.
  • Recommend retention of appropriate trial, coverage, recoupment, or appellate counsel to represent the insured or the company in litigation.
  • Manage and supervise outside or in-house counsel throughout all phases of litigation, including budgeting, strategy development, trial tactics, and performance evaluation.
  • Attend settlement conferences and mediations.
  • Provide periodic briefings and reports to management.
  • Investigate and pursue potential recoupment against parties responsible for losses.
  • Respond to Department of Insurance inquiries or complaints related to claim activity.
  • Maintain and update company loss and expense reserves for claim matters.
  • Maintain complete and accurate claim files in accordance with company guidelines and applicable regulations.
  • Provide litigation support, including testifying as company representative, verifying discovery responses, signing affidavits, and settlement agreements.
  • Collaborate with underwriters to investigate and analyze requests regarding insuring over or around title claim matters and make recommendations to corporate underwriting and legal.
  • Seek creative solutions to resolve claims or "make title as insured."

Requirements

  • Juris Doctor degree from an accredited law school.
  • Active bar license in at least one state.
  • Minimum of three years of experience in title and/or real estate law.
  • Strong preference for candidates with title insurance experience and/or claims adjudication experience.
  • Excellent organizational and interpersonal skills.
  • Strong analytical and problem-solving abilities.
  • Excellent written and verbal communication skills.
  • Ability to work effectively in a fast-paced environment.
