Overview
A leading homebuilder and real estate services organization is seeking a Claims Counsel to manage, evaluate, and resolve title insurance claims and related disputes. This role involves providing legal analysis and strategic guidance on complex title, escrow, underwriting, and real estate matters to mitigate financial and legal risk. The position collaborates closely with operations, underwriting, and leadership teams to support consistent and compliant claims handling nationwide.
This position may be performed remotely. Candidates residing in Texas, Colorado, Arizona, Florida, Georgia, Connecticut, Louisiana, and Wisconsin will be considered.
Responsibilities
- Manage title insurance claims from initial notice through resolution, including coverage analysis, investigation, negotiation, settlement, and litigation oversight
- Analyze title policies, commitments, endorsements, escrow instructions, and real property records to determine coverage, liability exposure, and appropriate claim strategy
- Provide legal advice and guidance to claims, underwriting, escrow, and operational teams on title, real estate, and insurance-related legal issues
- Direct and oversee outside counsel handling title claims and related litigation, including case strategy, budgeting, performance management, and settlement authority
- Negotiate claim resolutions, settlements, and releases in alignment with corporate risk tolerance, financial objectives, and regulatory requirements
- Ensure claims handling practices comply with applicable state insurance regulations, title insurance laws, and internal governance standards
- Maintain accurate documentation, reporting, and file management to support audits, regulatory inquiries, and executive reporting
- Identify emerging claim trends, systemic risks, and root causes; collaborate with business partners to recommend corrective actions, training, or process improvements
- Conduct all business in a professional and ethical manner to serve customers and enhance organizational goodwill and profitability
- Ability to travel overnight as needed

Qualifications
Education and Experience
- Juris Doctor (J.D.) from an ABA-accredited law school
- Active license to practice law in at least one U.S. jurisdiction; ability to obtain admission in additional jurisdictions as needed
- Minimum of 5 years of legal experience in title insurance claims, real estate litigation, insurance defense, or related practice areas
- Strong knowledge of title insurance policies, real property law, and escrow practices
- Experience managing litigation and working effectively with outside counsel
- Proven ability to evaluate risk, exercise sound judgment, and negotiate favorable claim outcomes
- Strong computer skills, including proficiency in Microsoft Office applications and ability to learn new programs/systems quickly
- Ability to follow written and oral instructions and use relevant applications
- Physical requirements include ability to sit for the majority of an 8-hour workday; use hands and fingers; reach with hands and arms; talk and hear; close and peripheral vision
- Work environment noise level is generally moderate
Preferred Qualifications
- Prior experience with a national title insurance underwriter or large real estate-focused organization
- Familiarity with multi-state regulatory environments and high-volume claims operations
- Background in process improvement, risk management, or claims analytics

- Annual salary range: $120,000 - $140,000, based on experience and qualifications
