Overview
A leading health and wellness platform is seeking a Production Counsel with substantial commercial, content, and creative industry expertise to join their expanding Legal department. This role involves collaborating directly with Creative, Marketing, and Production teams to structure and execute a wide range of production agreements, including SAG-AFTRA and performer contracts, music rights, branded partnerships, and vendor engagements. The position addresses unique challenges at the intersection of consumer health, direct-to-consumer brands, and commercial content production.
Responsibilities
- Evaluate, prepare, and finalize production and creative contracts such as SAG-AFTRA agreements, talent and performer deals, crew engagements, production services arrangements, and content licensing agreements
- Manage music rights for advertising campaigns, including synchronization licenses, master use authorizations, publishing arrangements, and custom composition deals with music production houses and independent composers
- Structure and execute contracts with advertising agencies, production houses, directors, photographers, and post-production suppliers for commercial campaigns, including master service agreements, influencer and brand partnership arrangements
- Serve as an embedded business affairs and legal resource for Creative and Production teams, providing counsel on transaction architecture, SAG-AFTRA signatory requirements, broadcast clearance standards, and AI-related considerations such as generative AI usage, AI-generated content ownership, and vendor AI provisions
- Facilitate rights acquisition and clearance processes for commercial productions, including talent likeness and image permissions and third-party intellectual property clearances
- Develop and maintain scalable production workflows, deal memo templates, and contract management processes for commercial and marketing production operations, ensuring SAG-AFTRA signatory compliance and appropriate AI vendor terms
Requirements
- Juris Doctor degree from an ABA-accredited law school
- Current bar admission in at least one U.S. jurisdiction
- Minimum of 5 years of legal practice experience in a law firm and/or in-house setting, with at least 4 years focused on commercial advertising production, performer contracting, or media/entertainment business affairs
- Proven experience preparing and executing commercial advertising contracts, including SAG-AFTRA commercial agreements, on-camera and voice-over performer deals, music rights agreements, deal memos, production house contracts, and performer usage and exclusivity arrangements
- Knowledge of SAG-AFTRA guild rules, signatory responsibilities, and low-budget/new media contract frameworks
- Experience drafting and negotiating intellectual property licensing and content clearance agreements
- Exposure to AI-related legal issues in creative or marketing contexts, including generative AI policies, ownership of AI-generated content, and drafting AI-related terms in vendor and platform contracts
- Ability to adapt quickly in a fast-paced, dynamic environment with competing priorities
- Strong interpersonal and communication skills with the ability to provide practical, commercially grounded legal guidance to diverse stakeholders
- Demonstrated ability to balance legal risk with business objectives
- Collaborative and constructive approach with a pragmatic, results-driven mindset
Preferred Qualifications
- Experience working at an advertising agency, commercial production company, talent agency, or in-house at a consumer brand or technology company with a high-volume commercial/marketing production operation
- Experience with music publishing companies, recording labels, or synchronization licensing
- Background in fast-paced technology companies, startups, or direct-to-consumer brands
- Hands-on legal counsel related to AI technologies and platforms used in creative, marketing, or content pipelines (e.g., generative image/video/audio tools, AI-assisted post-production, synthetic media applications)
- Familiarity with healthcare privacy laws and regulatory frameworks is a plus
