Overview

A Workers Compensation Defense Attorney is needed for an in-house litigation position under the direction of the General Counsel. This role involves defending litigated Workers’ Compensation claims primarily in and around the Kansas City area. The attorney will conduct legal research, examine records, investigate cases, attend depositions, consult with witnesses and insured parties, and collaborate with legal assistants and personnel. The position also includes participating in negotiations and settlements, as well as providing leadership and expertise on major company projects.

Responsibilities

  • Defend Workers’ Compensation claims before courts, arbitration panels, and administrative bodies.
  • Provide state-specific legal representation and advisory services to the organization and its employees.
  • Prepare legal pleadings, motions, memorandums, trial briefs, and appeals.
  • Conduct legal research and offer timely legal opinions and advice.
  • Participate in negotiations and settlements on behalf of the organization and policyholders.
  • Apply legal principles and judgment to solve legal issues.
  • Draft legal correspondence and memorandums with minimal supervision.
  • Provide objective risk assessments.
  • Work on special projects as assigned.

Requirements

  • Juris Doctor degree and admission to the bar in both Kansas and Missouri (in good standing).
  • Minimum of four (4) years of legal experience; at least two years preferred in the insurance industry.
  • Knowledge of federal and state laws and regulations governing insurance.
  • Ability to understand complex legal issues and provide sound legal advice.
  • Strong analytical, communication, leadership, management, and advocacy skills.
  • Skilled in policy development, training methods, and materials.
  • Basic to working knowledge of corporate policies, procedures, contracting concepts, and Uniform Commercial Code.
  • Ability to draft and review simple contractual instruments.
  • Ability to read, analyze, and interpret statutes, legal periodicals, professional journals, technical procedures, and governmental regulations.
  • High ethical standards and integrity.
  • Ability to work independently and collaboratively in a team environment.
  • Strong judgment and ability to influence senior management.
  • Understanding of business operations, financial/analytical issues, and profit and loss implications.
  • Excellent presentation, negotiation, organizational, verbal, and written communication skills.
  • Qualified to effectively present information and respond to questions from courts, regulators, clients, and the public.

Working Conditions

  • Primarily office-based work with no unusual hazards.
  • Travel required.
  • Must have a valid driver’s license and ability to drive.
  • Vision requirements include close vision, distance vision, color vision, and ability to adjust focus.
  • Frequent handling of documents, books, manuals; ability to reach, talk, and hear.

Compensation & Benefits

  • Estimated salary range: $121,500 to $203,400, depending on internal equity, candidate skills, experience, geographic location, and market factors.
  • Employment is on an "at will" basis.

Location

  • Primarily serving hearing locations in and surrounding the Kansas City area.
