Overview

The Director, Legal Claims Administration manages the Recovery Services area of the Legal Claims Administration Group and reports to the Senior Managing Director of Legal Claims Administration.

The Recovery Services team performs claim and defense analysis for causes of action arising under Sections 547, 550 and 502 of the U.S. Bankruptcy Code. The team prepares and serves Demand Letters and Complaints asserting causes of action pursued under Sections 547, 550, and 502 of the U.S. Bankruptcy Code, and (together with partner counsel) negotiates and provides litigation support to resolve these causes of action.

This role also supports client work through data analysis, case tracking, and resolution of matters related to Demand Letters or Complaints.

Responsibilities

  • Oversee all casework, managing a personal caseload while ensuring group responsibilities are completed effectively.
  • Serve as the first point of contact with clients; assist and support partner counsel in connection with settlement negotiations and mediation for each matter.
  • Obtain relevant data from the client and/or opponent; manage and analyze data and defend positions asserted by opposing parties and/or counsel.
  • Prepare independent data analyses in response.

Casework and document management

  • Prepare draft documents for client and/or counsel review, including Demand Letters, Complaints, settlement agreements, and settlement parameters.
  • Ensure work assigned to administrative staff (e.g., portfolio analysis, tracker maintenance, address research, corporate name research) is completed correctly and on time.

Demand Letter / Complaint prep

  • Work with clients and team members to obtain materials needed to prepare defense analysis, Demand Letters, and Complaints.
  • Supervise preparation of defense analysis and prepare summary analysis for client and counsel noting rationale for excluding certain transferees from receiving Demand Letters or Complaints.
  • Conduct or manage research on corporate names/addresses of principal places of business and registered agents in states of incorporation.
  • Prepare templates for Demand Letters and Complaints, or provide templates for counsel to consider.
  • Prepare or supervise preparation of mail merge files for Demand Letters and Complaints.
  • Manage production and mailing/filing of Demand Letters and Complaints.
  • Manage service of Summonses and Complaints.

Resolve cases and support settlements

  • Arrange settlement parameters with the client.
  • Coordinate with the client’s counsel and payees and/or their counsel on settlement negotiations.
  • Evaluate data-based client preference defenses asserted by transferees.
  • Conduct and/or facilitate secondary defense analysis.
  • Coordinate with partner counsel on responses to correspondence received from transferees regarding demand letters and complaints.
  • Prepare or manage preparation and execution of settlement agreements with the opponent.
  • Track case status, completion of settlement agreements, and receipt of settlement funds.

Overall portfolio and communications

  • Coordinate with direct supervisor and counsel on completing and managing case communications.
  • Facilitate completion of secondary defense analysis for individual preference matters.
  • Manage preparation and execution of settlement documents, and coordinate with counsel on motions seeking approval of settlement agreements (when applicable), as well as mediations and any pleading filed in the avoidance actions.

Case tracker maintenance

  • Work with other staff to maintain all portfolio status trackers.
  • Set weekly or bi-weekly meetings to discuss issues with the client, counsel, and other staff.
  • Ensure updated trackers are circulated at bi-weekly intervals or on the schedule agreed to with the client.

Other tasks

  • Support research with the Business Development Team for future potential portfolios of preference cases.
  • Address tasks assigned by the direct supervisor promptly.
  • Address requests from the client promptly and consult with the direct supervisor when necessary.
  • Provide status updates on task completion at intervals set by the direct supervisor.
  • Provide occasional support to other areas of the Legal Claims Administration group.

Requirements

  • J.D. or MBA.
  • At least 5 years’ experience working on corporate restructuring matters.
  • Deep familiarity with the U.S. Bankruptcy Code and the bankruptcy process.
  • Intermediate level proficiency in Excel to utilize and manage the preference defense analysis model directly.

Preferred Qualifications

  • Bankruptcy litigation experience.
  • Experience managing preference matters or other avoidance actions.
  • Experience with DocuSign.
  • Experience with PACER/ECF.
  • Experience with research tools such as Westlaw and Lexis.

Professional Development
