Overview
This role supports the organization’s litigation and investigative efforts to help defend against insurance fraud. Responsibilities include pursuing affirmative actions, including RICO-based litigation, and negotiating and litigating complex matters within the state of New York.
Responsibilities
- Collaborate with the Claims/Special Investigation Unit (SIU) to combat fraudulent claims in No-Fault and other cases.
- Research, prepare, file, and litigate fraud cases, including RICO and other Affirmative Actions.
- Develop litigation strategies for legal matters.
- Review case files and plan resolutions.
- Draft discovery requests, motions, memorandums, and legal briefs.
- Prepare for and conduct Depositions and Examinations Under Oath (EUOs).
- Attend arbitrations, mediations, and trials.
- Work with expert witnesses in the preparation of, or defense of, litigation.
- Represent the organization in court appearances (conferences, hearings) in State and Federal courts.
- Draft pre-trial and post-trial motions.
- Negotiate settlements and prepare related documentation.
Requirements
- Juris Doctorate and active membership in good standing with the New York State Bar.
- Federal Court Admission or the ability to seek admission upon selection for this role.
- 4 or more years of experience.
- Ability to manage and oversee intermediate-level litigation matters.
- Legal research and writing skills.
- Proficient with Microsoft Office and related computer applications.
- Demonstrates ethics and integrity.
- Exercises discretion and maintains confidentiality.
- Knowledge of legal holds and discovery processes.
- Team player who enjoys collaborating with colleagues daily.
Preferred Qualifications
- Experience with insurance fraud litigation and insurance defense.
Compensation & Benefits
- Compensation: $130,000 - 158,000 annually, based on experience and qualifications.
- Background investigation required.
