Overview
This role involves serving as Marketing Counsel for a fast-growing consumer fintech organization. The Marketing Counsel will provide legal guidance to the marketing, brand, design, paid media, and product teams to ensure that creative campaigns and go-to-market initiatives are compliant, defensible, and executed efficiently. The position requires a strategic legal operator comfortable working in a fast-paced, collaborative environment with the ability to navigate ambiguity and evolving processes.
Responsibilities
- Provide real-time legal advice across the marketing lifecycle to support creative and campaign execution.
- Advise on advertising technology, privacy, and consumer data issues, including compliance with state privacy laws such as CCPA/CPRA, handling of personally identifiable information (PII), targeting, and disclosures.
- Structure and negotiate agreements with creators, influencers, and brand collaborators, ensuring compliance with FTC endorsement and disclosure rules, content rights, and platform terms.
- Design and review rewards programs, sweepstakes, contests, and promotions, including official rules, registration, bonding, and multi-state regulatory compliance.
- Advise on affiliate and partner marketing programs, including disclosures, tracking, and payout structures.
- Support production and content development, including talent agreements, music licensing, rights clearances, and vendor contracts.
- Collaborate with marketing and product teams on claim development, ensuring messaging is compelling yet legally defensible.
- Utilize AI tools to accelerate contract review, marketing review workflows, knowledge management, and issue-spotting while maintaining appropriate controls and confidentiality.
- Develop scalable, stage-appropriate processes and self-serve guidance to enable fast, compliant marketing operations as volume and complexity increase.
- Perform additional duties as assigned.
Requirements
- Juris Doctor (J.D.) degree and active membership in good standing with a U.S. state bar.
- Minimum of 8 years of legal experience, including at least 6 years focused on marketing, advertising, and/or ad tech law, gained at a leading law firm and/or in-house.
- Deep expertise in advertising and consumer protection law (FTC Act, UDAAP), promotions and sweepstakes, endorsement and influencer rules, affiliate marketing, and advertising-related privacy laws (CCPA/CPRA and other state privacy laws).
- Proven experience working directly with C-suite and executive leadership, influencing decisions and communicating clearly at senior levels.
- Strong drafting and negotiation skills for agency, vendor, talent, and marketing partnership agreements with attention to detail.
- Proficiency with AI tools and enthusiasm for leveraging them to improve team efficiency and quality.
- Business-oriented mindset with the ability to balance legal risk against product, brand, and commercial considerations in a fast-paced environment.
- Excellent communication skills across creative, technical, and non-legal audiences.
- Intellectual curiosity, comfort with ambiguity and risk, low ego, high ownership, and strong collaboration skills.
Preferred Qualifications
- Experience in technology, fintech, or financial services sectors.
- Familiarity with marketing in regulated industries.
- Prior in-house experience at a high-growth consumer brand or platform.
