Overview

This role supports default legal services for mortgage servicers, banks, investors, and other financial institutions. Responsibilities focus on managing and advancing foreclosure-related and related litigation matters, including loss mitigation, bankruptcy, post-foreclosure evictions, and surplus proceeds cases.

Responsibilities

  • Prepare pleadings, motions, and correspondence relating to judicial foreclosures, mediations, foreclosure-related litigation, loss-mitigation, bankruptcy, post-foreclosure evictions, and surplus proceeds cases.
  • Supervise paralegal staff in preparation of work product for foreclosure-related litigation, loss-mitigation, bankruptcy, post-foreclosure evictions, and surplus proceeds cases.
  • Manage assigned actions and serve as a primary client and staff point of contact.
  • Efficiently manage multiple files at different stages, including litigation issues, foreclosures, bankruptcy, evictions, excess proceeds, deeds in lieu, replevins, sales, probate, and other matters as assigned.
  • Research and apply law and facts applicable to assigned cases; review and digest regulatory changes and adjust work accordingly.
  • Prepare timely, high-quality legal work product, including letters, emails, documents, pleadings, motions, discovery, disclosure, and appellate briefs as assigned.
  • Review, audit, and edit legal work product produced by department staff.
  • Provide guidance, feedback, and approval on legal work product.
  • Maintain high ethical standards, including workload management, professional communications, and timeliness.
  • Provide excellent client service and communication, with emphasis on client communications and correspondence.
  • Attend court hearings, sales, mediations, trials, and oral arguments as required.
  • Learn and effectively use internal case management systems (CMS) and client shared platforms to keep files moving forward, maintain accurate records, complete tasks and events, and keep firm personnel and clients apprised of case status.
  • Contribute as a team player through collaboration and effective communication with colleagues.
  • Perform initial intake and strategy analysis for new cases assigned.
  • Research and prepare work accurately and efficiently.
  • Accurately record billable and non-billable work performed.
  • Assist with other tasks as assigned by the Managing Attorney.

Requirements

  • Juris Doctorate.
  • New Mexico Bar license in good standing.
  • 5 years of experience as an associate attorney.
  • Proficiency with relevant technology, including Westlaw and time-billing software.
  • Must be familiar with foreclosure work.
  • Background in real property, foreclosure, and title preferred.
  • Title background, including post-sale marketable title, is also desirable.
  • Dual licensure in New Mexico and one or more of the following states preferred: Texas, Oklahoma, Arizona, or Colorado.

Preferred Qualifications

  • Experience with judicial foreclosure-related matters, loss mitigation, bankruptcy, post-foreclosure evictions, and surplus proceeds cases.
  • Prior supervision of paralegal staff.
