Overview

This role is based at the Law Offices of the Public Defender in Alamogordo, NM, with the option to telework and manage cases remotely.

  • Regular working hours: 8:00 AM – 5:00 PM MST, Monday – Friday

This position focuses on providing high-quality legal services, developing strategies, and advocating for clients in court.

Responsibilities

  • Handle felony probation violation adjudications
  • Conduct felony arraignments
  • Present arguments related to conditions of release and evidentiary hearings
  • Attend hearings to determine whether conditions of release can reasonably assure the safety of the community and individuals within the community (5-409 hearings)
  • Provide occasional substantive motion writing for felony cases on a trial track, including suppression motions
  • Represent clients in all misdemeanors or juvenile cases and low to medium level felonies with limited supervision
  • Provide guidance and mentoring to lower-level attorneys and law clerks
  • Work under the direction and guidance of higher-level attorneys and/or the Managing Attorney
  • Conduct plea bargaining when appropriate with District Attorneys and other parties to establish case resolutions
  • Attend seminars and training classes, and review current professional literature to maintain and develop professional skills and knowledge
  • Draft, review, propose, and prepare reports and legal documents
  • Meet with clients, file and argue motions, investigate cases, interview witnesses, proceed to trial, and file necessary appeals
  • Analyze probable case outcomes using investigation and case law to determine whether a client should enter a plea or proceed to trial
  • Support appellate matters by interviewing clients and trial counsel, reviewing the record, and researching to support arguments that errors were made by lower courts
  • Perform related and other duties as assigned

Requirements

  • Ability to represent clients in all misdemeanors or juvenile cases and low to medium level felonies with limited supervision
  • Demonstrated passion for litigation and strong communication skills
  • Ability to show competence in all levels PD2 through PD3
  • This classification may require performing duties at a PD3 level or duties of a lower classification without additional compensation
