Overview

A growing telehealth organization is seeking a Senior Counsel to serve as the dedicated legal architect for its direct-to-consumer (DTC) health business. This role involves ensuring marketing and operations scale responsibly while navigating complex healthcare regulations. The Senior Counsel will help transform legal requirements into competitive advantages by providing expert guidance on regulatory compliance.

Responsibilities

  • Act as the primary legal partner for growth and creative teams, reviewing digital advertisements, landing pages, and influencer content to ensure compliance with FTC and platform standards.
  • Provide expert counsel on FDA regulations related to prescription and compounded medications, claims substantiation, and state-level anti-kickback and consumer protection laws.
  • Develop scalable review workflows and self-serve legal guardrails to enable marketing teams to operate efficiently without manual legal bottlenecks.
  • Advise on HIPAA compliance, patient consent, and the use of tracking technologies (such as pixels) within healthcare e-commerce and acquisition funnels.
  • Draft and negotiate specialized agreements with influencers, marketing agencies, and pharmacy partners, focusing on compounded medication and cash-pay models.
  • Perform other legal duties as assigned.

Requirements

  • Juris Doctor (J.D.) degree from an accredited law school.
  • Active bar membership in at least one U.S. jurisdiction, with the ability to register as in-house counsel where required.
  • Minimum of 10 years of experience in healthcare law, with significant focus on healthcare marketing, advertising, and promotional regulatory matters.
  • Deep knowledge of FDA promotional regulations, FTC advertising standards, HIPAA, and state consumer protection and healthcare advertising laws.
  • Proven experience reviewing and approving DTC healthcare marketing at scale across digital channels.
  • Excellent judgment and ability to translate complex regulatory frameworks into clear, practical guidance for non-legal teams.
  • Strong written and verbal communication skills.
  • Ability to operate independently in a fast-paced environment.

Preferred Qualifications

  • Prior in-house legal experience at a telehealth, digital health, or DTC healthcare company.
  • Experience advising on GLP-1s/obesity medications, hormone therapies (such as TRT, menopause, thyroid), or longevity and wellness products, including compounded formulations.
  • Familiarity with the MSO/friendly-PC model and the corporate practice of medicine doctrine across multiple states.
  • Experience with performance marketing workflows, ad-tech, pixel privacy issues, and AI-enabled marketing tools.
  • Track record managing NAD challenges, FTC inquiries, or state attorney general investigations.
