Overview
This role offers an opportunity for an experienced attorney to serve as Senior Claims Counsel within a title insurance company. The position involves managing complex legal claims related to title insurance and escrow, including coverage determinations, litigation oversight, and settlement negotiations. It is suited for a candidate seeking an in-house legal role with meaningful, complex work and a focus on problem-solving rather than billable hours or business development.
Responsibilities
- Investigate claims to determine coverage and evaluate potential losses under title policies
- Assess defenses for insured parties and the company
- Decide when to retain outside counsel and manage litigation through to resolution
- Negotiate settlements with claimants, opposing counsel, and third parties
- Represent the company in court proceedings, mediations, settlement conferences, and trials
- Manage claim budgets, approve outside counsel invoices and expenses, and determine reserves
- Direct outside counsel on litigation strategy throughout claim administration
- Identify and pursue sources for recovery
Requirements
- Minimum 12 years of legal experience with emphasis on real estate matters such as title, ownership of real property, liens, easements, encumbrances, and escrow
- Experience with insurance coverage, including litigation, mediation, and arbitration
- Specific expertise in title insurance, escrow, and lender matters is highly desirable
- Juris Doctor (JD) degree required
- Licensed and in good standing to practice law in any U.S. state
- Excellent written and verbal communication, negotiation, and organizational skills
- Ability to develop, evaluate, and implement resolution strategies to fully conclude claims
- Demonstrated ability to work independently with originality and sound judgment
Compensation & Benefits
- Salary range: $129,300 to $172,300 annually
- Pay is based on factors including knowledge, skills, experience, business requirements, and geographic location
