Overview
An established biopharmaceutical organization is seeking an experienced Market Access Attorney to provide expert legal advice and strategic guidance on market access initiatives. This role focuses on pricing, reimbursement, and distribution strategies while ensuring compliance with applicable laws and regulations. The position supports business objectives in a competitive and evolving healthcare landscape.
Responsibilities
- Advise on legal issues related to market access, including government pricing, reimbursement, formulary placement, and patient support programs.
- Draft, review, and negotiate agreements with payers, pharmacy benefit managers (PBMs), specialty pharmacies, and other stakeholders.
- Provide guidance on federal and state laws impacting market access, such as anti-kickback statutes, Medicaid, 340B, state drug pricing transparency laws, OIG guidance, and the False Claims Act.
- Monitor and advise on current and evolving legislation, regulatory changes, and enforcement trends related to market access; communicate implications to internal stakeholders.
- Collaborate with cross-functional teams and senior leadership to develop compliant strategies for product launches and lifecycle management.
- Support internal training and policy development related to market access to ensure adherence to legal and compliance standards.
Requirements
- Juris Doctorate (JD) degree.
- Minimum of 10 years of legal experience representing biopharmaceutical companies in North America, either as external or in-house counsel.
- Strong knowledge of healthcare laws, market access regulations, industry codes, and enforcement trends.
- Ability to manage competing demands and respond quickly to urgent situations across cross-functional teams.
- Exceptional written and verbal communication skills, with strong interpersonal abilities in both one-on-one and group settings.
- Excellent organizational and problem-solving skills.
- Capacity to make risk-based judgments and provide clear, practical, solution-oriented guidance on complex matters.
- Confidence to advise clients at all organizational levels with limited oversight.
- Proficiency in Microsoft Outlook, Word, PowerPoint, and Excel.

- Supervisory responsibilities: None.
- Travel: Approximately 5-10%.
Compensation & Benefits
- Salary range: $206,100 to $266,100 annually (base salary only).
- Eligibility for annual bonus or incentive compensation plans depending on role.
