Overview

A Senior Construction Counsel position is available, reporting to the Director of Operations Counsel. This role offers a hybrid or remote work arrangement based in San Jose, CA, with a salary range of $175,000 to $215,000. The position is eligible for an annual performance bonus plan. Compensation will be determined based on factors such as market location, job-related knowledge, skills, education, and experience.

Responsibilities

  • Review, negotiate, and document complex, multi-party construction contracts and change orders strategically and effectively.
  • Advocate for the organization's position in various situations, balancing risk limitation with maintaining valued relationships with customers, subcontractors, and vendors.
  • Provide practical legal counsel within a dynamic and diverse commercial environment.
  • Develop and maintain ongoing relationships with project management and execution teams, offering legal advice on construction project issues including contract compliance, change order and claim documentation, project notices, regulatory compliance, and subcontractor/supplier management.
  • Assist in designing, implementing, and continuously improving best practices for construction contract risk review, contract formation, and project execution processes.
  • Provide sophisticated analyses and recommendations to management regarding contract negotiations and legal advice on dispute resolution or claims pursuit.
  • Act as a strong advocate in claims and litigation matters.
  • Select and manage outside counsel resources to maximize value for the organization.

Requirements

  • Juris Doctor (JD) degree from an ABA-accredited law school.
  • Bar admission in at least one state, with good standing in all admitted states.
  • Minimum of 7 years of experience in a combination of law firm and in-house legal department settings, focusing on construction law.
  • Proficiency with Adobe, Microsoft Office Suite, Word, Excel, and Outlook.
