Overview
This role involves providing legal support primarily focused on commercial contracts and regulatory compliance within the pharmacy benefits management (PBM) sector. Reporting to the SVP, General Counsel and Chief Compliance Officer, the Senior Counsel will advise on a variety of legal matters, oversee outside counsel as needed, and support corporate development and compliance initiatives.
Responsibilities
- Drafting and negotiating contracts including pharmacy benefit management service agreements, pharmacy service agreements, and other agreements related to general and specialty PBM business lines.
- Developing responses to requests for proposals (RFPs) and requests for information (RFIs) to support PBM business growth.
- Collaborating with sales and account management teams on legal issues related to customer procurement and retention.
- Advising business leaders on regulatory compliance matters, particularly pharmacy operations, pharmacy and PBM licensing, ERISA, Affordable Care Act, fraud and abuse laws, and other federal and state healthcare regulations.
- Participating in the development and documentation of corporate policies, procedures, and programs.
- Assisting the Chief Compliance Officer in monitoring and developing the Corporate Compliance Program.
- Educating management on regulatory and fraud and abuse risks.
- Providing day-to-day legal counsel to colleagues involved in pharmacy benefit businesses, including developing best practices to mitigate legal and regulatory risks.
- Supporting corporate development projects and transactions by reviewing and identifying associated risks.
- Assisting in resolving disputes and inquiries from customers, business partners, and governmental/regulatory agencies.
- Performing other legal tasks as requested by senior management.
Requirements
- Juris Doctor (JD) degree.
- Licensed attorney in at least one state with the ability to obtain in-house counsel status with the Florida Bar.
- Experience in healthcare law preferred, including prior experience in a law firm or corporate legal department.
- Strong ability to identify legal risks and propose risk mitigation strategies.
- Capability to manage multiple projects simultaneously.
- Effective team collaboration skills.
- Excellent analytical, research, and legal writing skills.
Work Environment
- Typical office setting requiring prolonged sitting and use of standard office equipment such as computers and phones.
- May involve occasional high-stress situations when dealing with clients or customers.
- Some travel may be required.
