Overview
This role involves serving as Senior Product Counsel - Healthcare within the Legal team. The position partners with product teams to provide legal guidance grounded in how products operate in practice, with a focus on healthcare regulation and privacy. As products expand into additional regulated areas, the counsel will help teams quickly develop defensible positions and provide clear, actionable answers.
Responsibilities
- Provide healthcare regulatory expertise and legal analysis for navigating the U.S. regulatory environment for health technology, including:
- HIPAA
- State general and consumer health privacy laws
- Anti-Kickback Statute
- OIG Medicare and Medicaid regulations
- PhRMA codes
- TCPA and CAN-SPAM
- Accessibility requirements
- Card processing and payments regulations
- Other relevant areas of law
- Partner closely with Product by developing an in-depth understanding of the business and how each product works, advising on what is feasible within the regulatory environment.
- Build working expertise in adjacent regulated domains, including payments and card processing and financial services regulation.
- Translate regulatory complexity into practical guidance by partnering with executive, product, engineering, marketing, and sales teams to understand potential regulatory requirements and identify effective execution approaches.
- Develop processes that enable teams across the organization to execute based on legal guidance in ways that improve speed and efficiency.
- Protect patient data by partnering closely with the Chief Privacy Officer to ensure compliance and risk reduction.
- Strengthen the Legal team by contributing to improvement initiatives and supporting colleagues.
Requirements
- Bachelor’s degree required; JD from a top-tier law school
- 8+ years of healthcare regulatory experience across a combination of a top-tier law firm and in-house companies, preferably high-growth organizations
- Licensed to practice law in your state of residence
- Substantial product counseling experience, including advising product teams on regulated products from concept through launch
- Demonstrated ability to operate effectively in a remote environment
Preferred Qualifications
- Significant experience advising product and engineering teams on how to build and ship in a heavily regulated environment
- Ability to learn new areas of law quickly and translate unfamiliar statutes into practical, defensible guidance
- Strong legal and business judgment, with the ability to balance legal risk with business and commercial considerations
- Excellent ability to translate complex legal issues and risks into clear concepts colleagues with non-legal backgrounds can act on
- Comfortable engaging in dialogue around risk, including having assumptions challenged by internal product owners or outside counsel
- Ability to communicate effectively both in writing and live, including during real-time, tough questions
- Demonstrated ownership mindset and personal responsibility
- Ability to determine when precision and accuracy are essential versus when an 80% solution achieves the desired outcome
Compensation & Benefits
- Base Salary: $240,000-280,000 USD inclusive of base salary and variable incentive.
