Overview
This role involves serving as Senior Product Counsel - Healthcare on the Legal team. The position provides legal partnership to product teams, with a focus on healthcare regulation and privacy, while also supporting product areas that may touch payments, financial services, communications, and other regulated domains.
The work translates complex legal requirements into practical guidance that helps the business execute effectively in the applicable regulatory environment.
Responsibilities
- Act as the healthcare regulatory expert, providing legal analysis and ideas for navigating the U.S. regulatory environment for health technology, including:
- HIPAA
- State general and consumer health privacy laws
- Anti-Kickback Statute
- OIG Medicare and Medicaid regulations
- PhRMA codes
- TCPA and CAN-SPAM
- Accessibility
- Card processing and payments regulations
- Other relevant areas of law
- Partner closely with Product by developing a deep understanding of how each product works and advising teams on what is feasible within the regulatory environment.
- Build working expertise in adjacent regulated domains as products evolve, including payments and card processing and financial services regulation.
- Translate regulatory complexity into actionable guidance by partnering with executive, product, engineering, marketing, and sales teams to identify potential regulatory requirements and approaches to execution.
- Develop processes that help teams execute based on legal guidance in ways that improve speed and efficiency.
- Protect patient data by partnering closely with the Chief Privacy Officer to ensure patient data is not jeopardized.
- Strengthen the Legal team by contributing to improvements within the function and supporting colleagues.
Requirements
- Bachelor’s degree required; JD from a top-tier law school.
- 8+ years of healthcare regulatory experience across a combination of a top-tier law firm and in-house companies, preferably high-growth organizations.
- Licensed to practice law in your state of residence.
- Substantial product counseling experience, including advising product teams on regulated products, from concept through launch.
Preferred Qualifications
- Significant experience advising product and engineering teams on how to build and ship in a heavily regulated environment.
- Demonstrated ability to learn new areas of law quickly and provide practical, defensible guidance.
- Strong legal and business judgment with the ability to balance legal risk with business and commercial considerations.
- Ability to translate complex legal issues and risks into clear concepts colleagues with non-legal backgrounds can act on.
- Comfort engaging in dialogue around risk, including having assumptions challenged by internal product owners or outside counsel.
- Demonstrated ability to operate effectively in a remote environment.
