Overview
This role involves performing legal work related to the prosecution, negotiation, and resolution of disciplinary enforcement cases involving licensed healthcare professionals and regulated practitioners. The position requires reviewing investigative findings, developing case strategies, negotiating settlements, and representing the agency in hearings and administrative proceedings.
Responsibilities
- Prosecute enforcement cases at Informal Settlement Conferences (ISC) involving agency licensees.
- Review and analyze complex investigative files concerning alleged violations of statutes, rules, and professional standards.
- Prepare presentation packets, draft and negotiate agreed orders and remedial plans.
- Coordinate with legal assistants, investigators, and other staff to prepare documents, exhibits, and evidence.
- Collaborate with medical professionals regarding medical issues and practice.
- Review and approve work prepared by support staff.
- Negotiate and draft remedial plans and agreed orders reflecting ISC panel decisions.
- Assist with weekly quality assurance reviews, including drafting warning and dismissal letters.
- Review new complaints for possible resolution without formal investigation, draft settlement documents, and follow up with licensees.
- Prosecute contested cases at the State Office of Administrative Hearings (SOAH) for specific practitioner categories and administrative cases, including drafting pleadings, motions, case briefs, and Board orders.
- Represent the agency in all phases of contested case prosecution, including discovery, depositions, legal research, mediation, and finalizing agreed orders.
- Represent the agency as prosecutor at Temporary Suspension/Restriction Hearings and prepare related orders.
- Perform administrative duties such as scheduling, filing, mailing, and case file preparation.
Requirements
- Experience in litigation practice with moderate legal writing.
- Knowledge of basic medical terminology is helpful.
- Ability to use initiative and independent judgment under general direction.
Work Environment
- Due to office space limitations, principal job functions may be performed in a home-based office environment.
Location
- Position is based in Texas and involves cases regulated by the Texas Medical Board.
