Overview

A financial services organization specializing in rental home financing is seeking an Associate General Counsel to join its in-house legal team. This senior leadership role involves supporting legal strategy across regulatory compliance, commercial contracts, capital markets, default servicing, litigation management, and corporate governance. The position reports to the Chief Administrative Officer and General Counsel and includes oversight of the Default Servicing Paralegal, REO Property Manager, and Compliance Analyst.

Responsibilities

  • Advise and counsel on federal and state laws and regulations affecting mortgage lending, financial services, and employment, including ECOA, FCRA, FHA, BSA, HMDA, SCRA, consumer protection, anti-money laundering, and data privacy.
  • Monitor legislative and regulatory developments to anticipate business impact.
  • Draft, review, and negotiate commercial agreements such as vendor contracts, master service agreements, and non-disclosure agreements.
  • Advise internal stakeholders on contract terms, transactional risk, and legal and business implications.
  • Support underwriting guideline updates and advise on legal escalations and enhanced underwriting matters.
  • Provide legal support for technology initiatives, including new vendor systems, AI/ML, and proprietary technology solutions.
  • Direct default servicing, litigation, foreclosure, and bankruptcy strategy, ensuring timely and accurate resolution and trend reporting.
  • Manage third-party servicers and outside counsel to ensure compliance with applicable guidelines.
  • Oversee preservation, listing, and disposition of REO (real estate owned) properties and coordinate foreclosure-to-REO handoff.
  • Collaborate with Capital Markets on securitization transactions, whole loan sales, warehouse agreements, and corporate debt financings.
  • Support board governance, including reviewing meeting agendas and materials, drafting and reviewing minutes and resolutions, and overseeing entity management.
  • Partner with executive leadership and the board to strengthen governance, controls, and operational compliance.

Requirements

  • Juris Doctor (J.D.) degree from an accredited law school.
  • Active license to practice law in at least one U.S. jurisdiction, in good standing.
  • Minimum of 8 years of relevant legal experience in the financial services industry, including in-house counsel experience.
  • Excellent interpersonal and communication skills with the ability to build relationships and trust across an organization.
  • Proven negotiation skills and business acumen, with the ability to balance legal risk and commercial priorities.
  • Ability to maintain discretion with confidential and sensitive information.
  • Strong attention to detail in reviewing and maintaining documentation.
