Overview
A law firm is seeking a full-time Arizona-licensed attorney with at least 3 years of civil litigation experience to develop a long-term niche in probate, trust, and estate disputes. While prior probate experience is not required, strong civil litigation skills are essential. The firm provides structured training, modern systems, and a stable docket. Initially, about 30% of the caseload will involve active litigation, with an expectation that the role will evolve toward more non-contested probate matters over time.
This position offers typical working hours from 8:00 a.m. to 5:00 p.m., Monday through Friday, and can be performed fully remotely from anywhere in Arizona, with optional hybrid office time as needed.
Responsibilities
- Manage a litigation docket involving will contests, trust disputes, breach of fiduciary duty, and related probate matters.
- Draft pleadings, motions, discovery, and trial briefs.
- Take and defend depositions; appear at hearings, mediations, and trials.
- Work closely with clients dealing with grief, complex family dynamics, and inheritance issues, providing clear legal guidance.
- Collaborate with a team using modern systems and workflows to maintain efficient case progress.
Examples of Matters Handled
- Will contests involving capacity, undue influence, or alleged fraud.
- Trust and estate disputes concerning trustee misconduct, accounting issues, or distribution conflicts.
- Contested guardianship or conservatorship proceedings, including removal or appointment issues.
- Advising and representing personal representatives and trustees aiming to comply with legal obligations and avoid liability.
Qualifications
- Licensed to practice law in Arizona and in good standing.
- Minimum of 3 years of civil litigation experience, including state court motion practice, discovery, and hearings; trial experience is a plus.
- Strong writing and oral advocacy skills; comfortable in courtroom settings and direct client interactions.
- Organized, proactive, and capable of managing multiple cases and deadlines effectively.
- Emotionally intelligent, able to manage conflict, handle upset clients, and maintain productive conversations amid family tensions.
- Interest in learning probate, trust, and estate law and building a long-term practice in this niche; prior experience in these areas is a plus but not required.
Compensation & Benefits
