Overview
This role involves serving as a Senior-level Enforcement Attorney responsible for processing Potential Noncompliance (PNC) with Federal Energy Regulatory Commission (FERC)-approved and British Columbia Utilities Commission-approved mandatory Reliability Standards. The position supports the mission to maintain a highly reliable and secure bulk power system in the Western Interconnection by investigating, analyzing, and resolving compliance cases.
The position is remote-eligible for candidates residing in the lower 48 U.S. states, with an expectation of at least 15% travel.
Responsibilities
- Conduct legal research on North American Electric Reliability Corporation (NERC) precedents and Reliability Standards to ensure consistent and appropriate disposition of alleged violations.
- Review and assess registered entities’ potential noncompliance with NERC Reliability Standards in accordance with NERC Rules of Procedure and related guidance.
- Collaborate with Enforcement risk and mitigation engineers to conduct discovery and determine the scope and risk of potential noncompliance issues.
- Draft disposition documents and settlement agreements to resolve noncompliance cases.
- Interface with registered entity compliance and legal contacts regarding the status of open enforcement actions.
- Conduct penalty assessments, prepare settlement agreements, and participate in settlement negotiations.
- Provide legal and technical expertise when registered entities contest violations and request hearings.
- Ensure development of a complete evidentiary record for all noncompliance issues.
- Provide legal expertise and training to internal departments and registered entities on enforcement-related matters.
- Attend and participate in industry workshops and presentations to stay current on industry trends, guidance, and processes.
- Perform other duties as assigned.
Requirements
- Juris Doctor (JD) degree from an accredited law school.
- Admission to practice law in at least one U.S. jurisdiction.
- Minimum of 5-10 years of experience in energy law, administrative law, regulatory law, or complex litigation.
- Demonstrated experience leading complex cases and negotiations.
- Ability to learn and effectively use specialized systems such as Align, SEL, and case tracking tools.
- Detail-oriented with strong organizational and problem-solving skills.
- Strong computer literacy, including proficiency with Microsoft Office Suite.
- Understanding and adherence to cybersecurity principles, including protecting sensitive information and following organizational protocols.
Compensation and Benefits
- Base salary range: $96,700–$120,900 annually, plus discretionary pay and benefits.
- Salary is determined by role, level, skills, experience, and education.
