Overview
This role is an interim, contract in-house position for a data privacy and intellectual property attorney supporting a nationally recognized nonprofit higher education organization. Work is fully remote (work-from-home) with a flexible schedule expected to run part-time to full-time depending on workload.
Engagement length is approximately three months, with the opportunity for extension based on mutual agreement. Anticipated start date is ASAP.
Responsibilities
- Serve as the day-to-day in-house resource for data privacy and intellectual property questions
- Advise business, product, technology, and research stakeholders on privacy and IP matters
- Review, advise on, and negotiate the privacy and IP terms of vendor, platform, and data-sharing agreements
- Support the organization’s privacy compliance program
- Handle privacy program work including:
- Privacy notices
- Consent and preference practices
- Data subject or consumer rights requests
- Vendor privacy diligence
- Incident response support
- Provide guidance on commercial agreements, including data processing agreements, vendor and SaaS agreements, and data-sharing or research agreements
- Provide intellectual property counsel, including:
- Trademark and copyright matters
- Licensing
- IP provisions of technology and content agreements
Requirements
- 5+ years of experience practicing law, including substantive data privacy and intellectual property work
- Working knowledge of U.S. data privacy and data protection law, including state comprehensive privacy statutes
- Familiarity with education and student data frameworks, including FERPA and COPPA
- Experience advising on privacy and data protection terms in commercial agreements (e.g., data processing agreements, vendor/SaaS agreements, and data-sharing or research agreements)
- Intellectual property experience including trademark, copyright, licensing, and IP provisions of technology and content agreements
- Ability to support a privacy program in-house (privacy notices, consent and preference practices, consumer/data subject rights requests, vendor privacy diligence, and incident response support)
- Ability to work independently, advise business and technology stakeholders directly, and get up to speed quickly with minimal ramp-up
- Excellent academic credentials from an ABA-accredited law school
- Excellent analytical, written, verbal, and interpersonal skills
- Licensed to practice law in at least one U.S. jurisdiction and in good standing
- Outstanding professional references
Preferred Qualifications
- Prior in-house legal department experience strongly preferred
- Nonprofit, education, or technology platform experience a plus
- GDPR and other international privacy experience a plus
Compensation & Benefits
- Pay: The annualized pay for this position ranges from $180,000 to $210,000 when calculated on a full-time basis.
- Pay for contract engagements is based on multiple factors, including work experience, qualifications, credentials, location, market supply/demand, and the candidate’s preference. Each candidate’s pay rate affects the client bill rate which can affect the candidate’s competitiveness for the position.
