Overview
A leading mortgage services provider is seeking a Senior Counsel - Litigation with a strong background in the mortgage or real estate industry. This role requires a detail-oriented individual who enjoys working with both internal and external clients and thrives in a fast-paced environment with tight deadlines.
Responsibilities
- Oversee and manage litigation related to GSE loans from defaulted issuers by supervising, coordinating, and strategizing with outside counsel; ensure transparency to the account-owning GSE
- Advise senior executives on litigation strategies
- Supervise junior attorneys and paralegals
- Lead negotiations and revisions of renewing subservicing agreements with clients
- Manage all aspects of consumer finance litigation, including selection and management of outside counsel and legal billing administration
- Present periodic updates and risk reports to senior litigation counsel
- Provide legal advice to managers and supervisors; conduct research to guide operational processes and procedures
- Manage responses to discovery requests, including e-discovery
- Review and provide guidance on subpoenas duces tecum
- Assist internal business units with responses to external client information requests
- Identify litigation and regulatory complaint trends; communicate findings to senior litigation counsel and internal units; coordinate with Operations to develop remediation policies and procedures
- Support senior in-house counsel with legal advice and related assistance
- Perform other duties as assigned
Requirements
- Juris Doctor degree from an ABA-accredited law school and admission to the state bar
- Minimum of 7 years' experience in consumer/mortgage loan servicing litigation defense management
- Knowledge of mortgage origination, closing, and servicing practices
- Familiarity with various mortgage loan products such as conventional, ARMs, HELOC
- Understanding of loan documents including notes and mortgages/deeds of trust
- Knowledge of federal and state consumer finance laws and government-sponsored entity seller/servicer guidelines
- Expertise in federal laws/regulations governing residential mortgages (ECOA, FCRA, TILA, RESPA, FDCPA) and their application to business practices
- Experience representing mortgage servicers in consumer litigation claims including privacy, contested foreclosures, FDCPA, FCRA, TILA, RESPA, and other state/federal consumer protection disputes
- Experience overseeing complex litigation and responding to discovery requests including e-discovery
- Strong legal research skills and familiarity with tools such as Westlaw or LexisNexis
- Proven ability to work directly with management on residential mortgage default litigation issues
- Experience delivering presentations to clients and executive management
- Excellent verbal and written communication skills
- Ability to maintain confidentiality and privileged information
- Ability to work independently and collaboratively
- Strong organizational skills to manage multiple projects and meet deadlines in a dynamic environment
- Results-driven with attention to detail and commitment to best practices

- Experience supervising junior attorneys and paralegals

Compensation & Benefits
- Salary range: $103,000 to $193,100 annually, depending on qualifications and experience
