Overview

The Board of Immigration Appeals (BIA) is seeking Supervisory Attorney Advisors to lead teams of attorney advisors, judicial law clerks, paralegal specialists, and other professional support staff. The role involves managing the review of complex legal questions and drafting proposed orders with recommendations for disposition on a variety of immigration law issues. These proposed orders are then voted on for acceptance as final orders.

Responsibilities

  • Direct a team reviewing cases under 8 C.F.R. 1003.1(d)(3), applying "de novo" review to legal, discretionary, and judgment issues, and "clear error" review to factual findings and credibility determinations.
  • Monitor and examine formal filings for legal sufficiency and ensure procedural requirements are met in submissions from party representatives.
  • Review research conducted by the team to assess adequacy of evidence supporting administrative findings of fact and proper exercise of administrative discretion.
  • Provide guidance in evaluating facts and evidence to interpret and apply statutes and regulations in en banc matters, precedent decisions, or unusually complex cases.
  • Advise and counsel employees on work and administrative matters.
  • Prepare memoranda summarizing case facts and draft proposed orders for appellate Immigration Judges to review and vote on.

Requirements

  • Must be a U.S. Citizen or National.
  • Must complete a background investigation, credit check, and drug test.
  • Selective Service Registration is required, if applicable.
  • A two-year trial period may be required.
  • Salary payments must be made by direct deposit.
  • A Supervisory Probationary Period may be required.

Qualifications

Required Experience for GS-15 Level:

  • Possession of a J.D. degree.
  • Active membership in the bar of any U.S. jurisdiction.
  • At least 4 full years of post-J.D. legal or equivalent relevant experience.
  • U.S. citizenship or nationality.

Education

Education used to qualify must be from an institution accredited by a U.S. Department of Education recognized accrediting body. Transcripts or documentation supporting educational claims are required.

For foreign education, credentials must be evaluated by a private organization specializing in foreign education interpretation and deemed equivalent to accredited U.S. education programs. Translated transcripts are required.

  • This position may offer a remote work option with management approval.
