Overview
A well-established law firm specializing in trademark, trade dress, copyright, and unfair competition law is seeking a full-time Trademark Attorney with at least three years of full-time equivalent experience in trademark law. The firm is headquartered in Austin, Texas, with remote attorneys and paralegals across the continental United States and additional concentrations in the DC, San Francisco, and Minneapolis areas.
This role offers an alternative to traditional partnership-track positions, featuring a lower billable hour requirement and no business development or significant non-billable work obligations. Remote candidates are encouraged to apply, and attorneys local to Austin, TX, may work in-office but are not required to do so.
Responsibilities
Depending on experience and interests, the Trademark Attorney will:
- Manage and conduct U.S. and international trademark clearance searches and provide practical opinions on risk and brand strategy.
- Handle trademark prosecution matters, including filing U.S. applications, responding to office actions, and maintaining global trademark portfolios.
- Work on brand policing and enforcement, including assessing watch notices, sending cease and desist letters, negotiating dispute resolutions, and managing international policing through foreign associates.
- Handle other trademark and copyright matters such as licensing agreements, opposition/cancellation proceedings before the Trademark Trial and Appeal Board (TTAB), and copyright issues.
Requirements
- Juris Doctor (J.D.) from an accredited law school.
- Active state bar license in at least one U.S. jurisdiction.
- Minimum of three years full-time equivalent experience in one or more trademark areas: clearance, U.S. prosecution, U.S. and international portfolio management, routine enforcement, TTAB proceedings, or trademark litigation.
- Strong academic credentials.
- Excellent legal writing, research, and case management skills.
- Exceptional organizational skills.
- Must reside and be physically located within the continental United States.
- This position is not available to candidates requiring U.S. visa sponsorship (including H-1B, TN, or E-3 visas).
