Overview
A Senior Counsel specializing in Privacy & Data Protection is sought to provide expert legal guidance on privacy, data protection, artificial intelligence, and emerging technologies. This role involves advising on current and proposed privacy and data security laws and regulations, supporting contracting processes, identifying risks related to privacy and data security, and delivering practical solutions aligned with business needs.
Responsibilities
- Provide day-to-day legal advice to internal teams including Compliance, Legal, Operations, and Digital Technology.
- Serve as a subject matter expert on U.S. data privacy and data security laws and regulations, including federal and state privacy and consumer protection laws.
- Advise on data privacy compliance, privacy impact assessments, privacy training, and support updates to internal privacy compliance programs.
- Offer proactive legal guidance and training on data privacy, technology, data governance, and emerging AI and machine learning regulatory considerations.
- Analyze new laws and regulations related to data privacy, governance, and security, advising on regulatory and contractual implications.
- Understand and monitor cybersecurity frameworks and standards to ensure continuous calibration of cyber compliance.
- Support government relations on data privacy, governance, and security matters.
- Assist with legal coverage for regulatory examinations.
- Provide legal advice on data security incidents, including breach notification laws, third-party breach response, and client/regulatory inquiries.
- Review, draft, analyze, and negotiate vendor contracts, including data processing agreements and provisions related to data privacy and security.
- Oversee information governance issues such as litigation holds, document retention, and destruction policies.
Requirements
- Juris Doctorate from an accredited university.
- Minimum of 7 years of professional experience as a practicing attorney focused on privacy and information management, including experience in-house, at a regulatory agency, or law firm.
- Membership in good standing with the State Bar.
- Military experience is considered equivalent to professional experience.
Preferred Qualifications
- Significant legal experience advising on federal and state data privacy and data security laws (e.g., GLBA, HIPAA, NYDFS Cybersecurity Regulation), preferably within insurance or other highly regulated industries.
- Strong understanding of legal and regulatory requirements related to data privacy and security, especially those applicable to insurance companies or financial institutions.
- Experience leading negotiation and drafting of contracts for technology products, including those with AI features.
- Strong analytical, problem-solving, and legal research skills.
- Excellent business judgment, strategic thinking, and client counseling abilities.
- Proven ability to independently identify issues, analyze problems, and provide viable solutions.
- Excellent verbal, written, interpersonal, organizational, and negotiation skills.
- Ability to communicate effectively with all levels of personnel, including senior executives.
- Ability to manage assignments timely, exercise good business judgment, and work accurately under pressure.
- Certified Information Privacy Professional (CIPP) certification preferred.
Compensation & Benefits
- Base salary range: $190,000 to $240,000, influenced by experience, education, and skill set.
