Overview

This role supports an independent contractor real estate litigation attorney serving as counsel exclusively for the organization. The work focuses on resolving title and ownership issues tied to residential real estate acquisitions and resales across South Carolina, with the goal of achieving clear title for resale.

Estate administration (opening, reopening, and closing estates) is handled by separate probate counsel and is outside this engagement. Counsel will not represent estates, personal representatives, heirs, beneficiaries, or sellers.

Each property represents a separate legal matter, combining litigation, curative title work, and transactional support.

Responsibilities

Typical matters may include:

  • Developing and carrying out legal strategies to resolve title and ownership issues affecting acquisitions and resales.
  • Handling curative title matters, including issues involving prior conveyances, property descriptions, and liens.
  • Representing the client in quiet title actions, partitions, evictions, and related real estate disputes.
  • Representing the client in foreclosure-related proceedings, including intervention, substitution, or joinder of parties, and claims to surplus sale proceeds where applicable.
  • Preparing and reviewing deeds, corrective instruments, and court filings needed to implement the legal strategy.
  • Coordinating with the organization’s operations and transaction coordination team to assess legal issues, recommend next steps, and carry matters through resolution.
  • Serving the client exclusively (no representation of estates, personal representatives, heirs, beneficiaries, or sellers).

Requirements

  • Active member in good standing with the South Carolina Bar eligible under Rule 403.
  • Comfortable appearing in court and managing matters independently.
  • Strong drafting, negotiation, and problem-solving abilities.
  • Professional liability (malpractice) insurance.
  • Ability to assess complex facts, clearly explain legal options, and recommend practical next steps.
  • Currently operating an independent law practice, or willing to establish one.

Preferred Qualifications

  • Strong real estate litigation experience, particularly:
    • Quiet title actions

    • Title and ownership issues involving inherited property

Compensation & Benefits

  • Fees may be structured on a per-matter or transactional basis.
  • The fee arrangement can be refined over time as the working relationship develops.

Location

  • Travel within South Carolina is required as matters require.
