Patent Litigator

Overview

A remote contract position is available for a Patent Litigation Attorney to support an investment fund team managing a portfolio of consumer product brands, many operating in the e-commerce sector. The role focuses on evaluating the strength and enforceability of utility patents and advising on intellectual property enforcement and litigation strategies.

This engagement is expected to last approximately 3 to 6 months, requiring 10 to 20 hours per week, with flexibility to scale hours based on business needs.

Responsibilities

• Evaluate the strength, enforceability, and litigation viability of utility patents related to consumer product brands
• Conduct infringement analyses of suspected knockoff products by reviewing online product listings, images, descriptions, manuals, videos, and other publicly available materials
• Prepare clear and well-supported infringement claim charts mapping patent claim elements to accused products using publicly available evidence
• Provide practical assessments of potential infringement claims, advising on whether enforcement or litigation is warranted from legal and business perspectives
• Analyze competitor and knockoff activity in online marketplaces to determine if products infringe existing patent claims
• Advise internal legal and marketing teams on enforcement strategies, competitive threats, and actions to protect brand value
• Communicate strengths, weaknesses, and evidentiary gaps in potential enforcement matters to support informed decision-making

Requirements

• Significant experience in patent litigation, particularly involving utility patents
• Strong ability to evaluate litigation viability and enforcement strategies
• Experience assessing intellectual property infringement risks and enforcement options
• Proficiency in utility patent analysis and infringement review
• Experience preparing infringement claim charts
• Comfortable analyzing online marketplace listings and knockoff products
• Good communication skills with the ability to provide clear guidance to business stakeholders
• Comfortable working in a part-time advisory capacity

Compensation & Benefits

• Annualized pay ranges from $210,000 to $360,000 on a full-time basis, with contract pay rates determined by factors including experience, qualifications, credentials, location, market supply/demand, and candidate preference
