Overview
This role serves as the dedicated legal resource for the Servicing team, providing daily operational guidance on consumer loan and mortgage loan servicing and collections matters. The Assistant General Counsel, Servicing supports loss mitigation programs, collections strategy, default management, and regulatory compliance, and serves as the primary legal representative for issues impacting serviced loan portfolios, customer communications, and servicing operations.
Responsibilities
- Lead compliance analysis and policy development under Reg X (RESPA), Reg Z (TILA), FDCPA, UDAAP, TCPA, and applicable state servicing and collections laws, including GSE and agency servicing guidelines.
- Draft, review, and maintain loss mitigation policies, collections strategies, and servicing procedures, ensuring alignment with regulatory obligations, procedural requirements, and investor obligations.
- Identify, assess, and mitigate legal and regulatory risks; advise on structuring for current and new investment products and strategies to ensure compliance with applicable laws.
- Monitor regulatory developments and advise on implementation of new rules affecting servicing and collections operations.
- Review and negotiate vendor contracts and statements of work (SOWs) supporting collections and default management functions (e.g., third-party collectors, BPO servicers, foreclosure counsel).
- Partner with Capital Markets and Portfolio Management on servicing representations, covenants, and compliance requirements in asset sale and securitization transactions.
- Support regulatory examination management and respond to consumer complaints escalated through CFPB, state agencies, or litigation channels.
- Perform other responsibilities as assigned by supervisors or other managers related to the position/department.
Requirements
- Minimum 10 years of experience as a practicing attorney, with substantial time spent in consumer loan servicing, collections, or default management.
- Ideally includes in-house experience at a consumer finance and/or mortgage servicer or subservicer, and/or experience as a GSE/agency approved seller-servicer and/or consumer finance lender.
- Deep working knowledge of servicing and consumer debt collections laws and practice, including applicable state collections and foreclosure laws (e.g., FDCPA, TCPA, FCRA, UDAAP, TILA, RESPA, ECOA), and related title and lien resolution issues.
- Demonstrated experience advising on loss mitigation structuring and post-default strategy in a consumer finance, mortgage finance and/or home improvement lending context.
- Fluency in FDCPA and TCPA compliance for collections outreach, including state collections licensing requirements and regulatory classification of collections operations.
- Familiarity with AI governance and emerging regulatory frameworks applicable to AI use in collections and financial services operations.
- Ability to deliver clear, operationally actionable legal guidance and to own and stand behind a legal position in a fast-paced business environment.
- Membership in applicable state bar in good standing.
- Juris Doctor degree from an ABA accredited law school.
- Ability to juggle multiple workstreams under tight deadlines.
- Clear writing and verbal communication with business professionals and counsel.
- History of working well with business professionals and cross-functional teams (internal and external).

Compensation & Benefits
- $240,000–$260,000 annually
