Overview

This role serves as a legal and compliance partner focused primarily on mortgage origination. Responsibilities include providing legal research and regulatory guidance, supporting the regulatory change function, and supervising a junior attorney. The position translates legal and regulatory requirements into practical guidance, policies, procedures, business needs, and system requirements, and supports the organization’s compliance program.

Responsibilities

  • Research and analyze federal and state laws and regulations affecting mortgage origination and related business activities.
  • Provide clear, practical legal advice and recommendations to leadership and business stakeholders.
  • Prepare legal memoranda and written analyses on complex regulatory and compliance matters.
  • Interpret new and amended regulatory requirements and determine how they apply to the organization.
  • Partner with the regulatory change implementation function on impact assessments and communication of regulatory changes to business units.
  • Support implementation of regulatory changes, including updates to policies and procedures.
  • Review and resolve escalated legal and compliance matters from the compliance inbox.
  • Evaluate borrower rescission requests and advise on required actions and timing.
  • Advise on post-closing compliance matters, including corrective actions, cures, and remediation.
  • Support power-of-attorney and trust reviews for loan transactions.
  • Manage and prioritize legal and compliance origination issues, as identified.
  • Translate legal and regulatory requirements into practical, risk-based guidance for business partners.
  • Turn regulatory requirements into business and system requirements, controls, and processes for Encompass, Mavent, and other platforms.
  • Supervise, train, and mentor a junior attorney, including assigning work and reviewing work product.
  • Partner with the EVP, Regulatory Counsel on complex regulatory matters and business challenges.
  • Keep the EVP, Regulatory Counsel informed of significant matters, emerging risks, and priorities, with recommended courses of action.

Requirements

  • Juris Doctor (J.D.) and an active bar license in good standing in at least one U.S. jurisdiction.
  • 5+ years of legal or regulatory compliance experience in mortgage lending or financial services.
  • Experience interpreting regulatory changes and advising on their implementation.
  • Extensive knowledge of mortgage origination laws and regulations, including TILA/Regulation Z, RESPA/Regulation X, ECOA/Regulation B, HMDA, FCRA, the SAFE Act, UDAAP, and state lending and licensing requirements.
  • Advanced legal research, analysis, and writing skills, including the ability to explain complex legal concepts to business and executive audiences.
  • Skill in converting regulatory requirements into operational and technology requirements.
  • Excellent communication, strategic thinking, and problem-solving skills.
  • Sound judgment to manage a high volume of matters and competing deadlines.
  • Excellent collaboration, organizational, and problem-solving skills.

Preferred Qualifications

  • Experience supervising or mentoring attorneys or compliance professionals.
  • Experience with loan origination systems (Encompass preferred).
  • Experience with compliance technology such as Mavent.
