Overview

The organization is building the first new healthcare clearinghouse in decades and is hiring a Head of Litigation to aggressively protect and expand freedom to operate.

This role supports a broad range of matters across antitrust, information blocking, HIPAA Administrative Simplification, complex commercial disputes, and regulatory questions related to expansion into payments and Treasury.

In the healthcare sector, the Health Insurance Portability and Accountability Act of 1996 (HIPAA) requires insurance payers to exchange transactions (claims, eligibility checks, prior authorizations, and remittances) using a standardized EDI format called X12 HIPAA. Clearinghouses process the majority of these transactions, offering consolidated connectivity to carriers and providers. Routing arrangements, exclusive relationships, and contractual terms often determine access to payers.

Responsibilities

  • Own affirmative disputes end-to-end, from theory and factual development through demand letters, regulatory complaints, and litigation.
  • Build the record before there’s a case by forming strategies, directing investigations, and using preservation and data analysis so claims are credible when raised.
  • Lead both regulatory-enforcement and litigation tracks, selecting the appropriate enforcement path (including HIPAA Administrative Simplification complaints, state insurance regulators, and federal and state antitrust authorities).
  • Defend the organization across commercial, customer, and other disputes.
  • Own outside counsel selection, scope, and budget, retaining specialists deliberately, keeping work in-house where possible, and holding firms to high standards.
  • Translate legal disputes into commercial outcomes in partnership with executive leadership and Legal and Policy teams (e.g., settlement, contract change, direct payer connection, or judgment).
  • Build and automate legal infrastructure (litigation holds, preservation and discovery readiness, privilege hygiene, matter tracking) so a lean team can execute.
  • Provide leadership with honest assessments and sophisticated reasoning.

Requirements

  • 12+ years litigating complex commercial disputes, with first-chair experience.
  • Strategic approach to determining when and how to use laws and regulations affirmatively.
  • Experience initiating matters and building cases (not only responding).
  • Depth in some combination of:
    • antitrust and unfair competition
    • complex contract disputes
    • regulatory enforcement
  • Healthcare and technology backgrounds are strongly preferred; deep experience in another heavily regulated, complex industry (financial services, payments, insurance, telecom) will be considered.
  • Resourceful and frugal budgeting instincts; a default approach is not to hand off to large firms without justification.
  • Strong judgment and realistic odds assessment, including identifying weaknesses early and clearly deciding when not to pursue.
  • Strong writing skills; written work should require very little additional support.
  • Credibility with engineers; ability to follow and understand API-related technical discussions.
  • Fast execution; expectation that legal keeps pace with business.
  • Philosophical alignment with the organization’s standards.
  • JD and membership in at least one U.S. state bar.
